By downloading, installing, or using Pocket Billions (the "App"), you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree, do not use the App.
Pocket Billions is a simulated ("paper") stock-trading app. It lets you practice buying and selling real, publicly-traded stocks using entirely virtual, fake money, priced against live or recent market data supplied by a third-party data provider.
The App is for educational and entertainment purposes only. Pocket Billions is not a broker-dealer, investment adviser, exchange, or financial institution of any kind. No real money, securities, or other financial instruments are ever bought, sold, held, or transferred through the App. Nothing you do in the App has any effect on any real brokerage account, bank account, or financial position you may hold elsewhere.
Nothing in the App — including stock rankings, risk labels, recommendations, "Top Picks," Automation Mode's automated trading behavior, or any other content — constitutes financial, investment, tax, or legal advice, or a recommendation to buy or sell any real security. Past or simulated performance within the App is not indicative of future results, real or simulated. You should not make real-world financial decisions based on anything in this App. Consult a licensed financial professional for actual investment advice.
You must be at least [13] years old to use the App. If you are under the age of majority in your jurisdiction, you may only use the App with the involvement of a parent or guardian, to the extent required by applicable law.
The App displays stock prices and historical data obtained from a third-party market data provider (currently Tiingo, Inc.). This data may be delayed, incomplete, inaccurate, or temporarily unavailable, and we do not guarantee its accuracy, completeness, or timeliness. The App is not a real-time trading terminal and should never be relied upon for real-world trading or investment decisions.
The App includes an optional "Automation Mode" feature that automatically opens and closes simulated positions on your behalf according to rules you configure (such as take-profit and stop-loss thresholds). Automation Mode operates entirely on simulated, virtual funds using a combination of real market data and, for positions it currently holds, fabricated short-interval price movement designed to give the feature something to react to between infrequent real price updates — this fabricated movement is disclosed in the App's Settings and does not reflect real market prices. Automation Mode's trading logic is a simple, rules-based simulation; it is not an investment strategy, is not designed or intended to be profitable, and its behavior — in the simulation or if any similar logic were ever applied to real trading — is not guaranteed or endorsed in any way.
You agree to use the App only for its intended purpose and not to:
If you choose to enter a market-data API key (e.g., from Tiingo) into the App's Settings, you are responsible for obtaining that key in compliance with the relevant provider's own terms of service, and for any usage or charges associated with your account with that provider. See our Privacy Policy for how that key is stored.
The App, including its design, text, graphics, logos, and underlying code, is owned by [Your name / business name] or its licensors and is protected by applicable intellectual property laws. Except for the limited right to use the App for its intended personal, non-commercial purpose, these Terms do not grant you any rights to our intellectual property.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT MARKET DATA DISPLAYED WILL BE ACCURATE OR CURRENT.
TO THE FULLEST EXTENT PERMITTED BY LAW, [YOUR NAME / BUSINESS NAME] SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. BECAUSE THE APP INVOLVES NO REAL MONEY, OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID, IF ANY, TO DOWNLOAD THE APP.
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.
You agree to indemnify and hold harmless The Digital Bubble from any claims, damages, or expenses (including reasonable legal fees) arising out of your misuse of the App or violation of these Terms.
We may modify, suspend, or discontinue the App, or any feature of it, at any time. We may also update these Terms from time to time; material changes will be reflected by updating the "Effective date" above. Continued use of the App after a change constitutes acceptance of the updated Terms.
We may suspend or terminate your access to the App at any time, for any reason, including if we believe you have violated these Terms. You may stop using the App at any time by deleting it from your device.
These Terms are governed by the laws of Australia, without regard to its conflict-of-law principles, unless otherwise required by applicable local consumer protection law.
Because the App is distributed through Apple's App Store, the following additional terms apply and take precedence over any conflicting term above, as required by Apple:
